2018 SDHR Forum Annual Employment Law Update

Legal Update Topics

  • AB 1008: “Ban the box” restriction on when employers may ask about/consider criminal history
  • AB 168: Prohibition on asking about salary history (state law, plus San Francisco ordinance)
  • SB 63: Parental leave expanded to employers with 20-49 employees
  • AB 450: Prohibition on voluntarily consenting to ICE access to the workplace without a judicial warrant, new notice provisions (could split this one into two)
  • SB 306: Allows DLSE to initiate retaliation investigations without a specific employee complaint

  • Arbitration agreements: Morris Case
  • Commissions and rest break pay (Vaquero v. Stoneledge)—requires that employees paid on commission and subject to inside sales exemption be paid hourly for all non-sales/rest break time.
